1. Purpose and acceptance of the Terms
These Terms of Use govern access to and use of BikeAsOne, its pages, tools and features, including those identified as Premium.
Use of the service implies acceptance of these Terms. Users who do not accept them must stop using BikeAsOne.
2. Access to the service
BikeAsOne is provided within the limits of available technical resources. Access may require a compatible device, a recent browser, an Internet connection, activation of certain device permissions and, for some features, geolocation, Bluetooth or access to sensors.
Users are responsible for having compatible equipment, connectivity and configuration. Costs relating to Internet access, devices, mobile data or other equipment remain their responsibility.
3. User account
Users are responsible for information provided when creating and using their account and for keeping their credentials confidential. They must promptly report any unauthorised use they become aware of.
An account must not be used to impersonate a third party, bypass access restrictions, disrupt the service or carry out unlawful activity.
4. Features, measurements and displayed data
BikeAsOne may display or process routes, GPS tracks, distances, speeds, elevation gain, durations, positions, sensor data, heart-rate information, navigation instructions or information from connected accessories.
This information may be affected by GPS accuracy, network quality, device sensors, accessories used, battery level, environmental conditions, system permissions, mapping data or software errors. It is provided for information only and is not guaranteed to be accurate, complete or permanently available.
5. Cycling, navigation, radar, heart rate and safety
Users remain solely responsible at all times for their riding, trajectory, speed, route choice, equipment and compliance with applicable rules. They must remain attentive to the road, other road users, signs and actual traffic conditions.
Visual or voice navigation, mapping, possible vehicle detection by compatible radar, heart-rate information and any other alerts are not infallible safety systems. The absence of an alert never means there is no danger.
6. Availability, bugs and interruptions
BikeAsOne does not guarantee continuous, permanent, secure or error-free operation. Bugs, anomalies, slowdowns, connection losses, temporary unavailability, display errors, synchronization failures or interruptions may occur.
The service may be interrupted for maintenance, updates, technical changes, incidents, outages, hosting issues, provider failures, overload, network problems, security requirements or events beyond the publisher’s control.
No guarantee is provided of 100% availability, permanent data retention or compatibility with all devices, browsers, systems or accessories.
7. Changes, suspension or discontinuation of BikeAsOne
BikeAsOne is a service that may evolve. Subject to applicable legal provisions and contractual commitments, features may be added, modified, replaced, limited or removed.
9. Prohibited uses
BikeAsOne must not be used unlawfully or in a way that harms the service, its users or third parties. In particular, the following are prohibited:
- fraudulent access or attempts to bypass the service’s access controls and security mechanisms;
- introducing malicious code, deliberately exploiting a vulnerability or taking any action intended to disrupt the service;
- large-scale automated collection of data without authorisation;
- publishing unlawful, fraudulent or threatening content or content infringing third-party rights;
- using the service to track, monitor or locate a person without a legitimate basis or without consent where required.
10. Content and information provided by users
Users remain responsible for content, information, tracks, comments, images or other material they transmit or publish. They warrant that they have the necessary rights and permissions and agree to comply with the law and third-party rights.
Content that is manifestly unlawful or contrary to these Terms may be removed or made inaccessible where necessary or legally required.
11. Intellectual property
Unless otherwise stated, the structure of BikeAsOne, its visual identity, graphic elements, texts, software, interfaces, databases and proprietary content are protected by applicable intellectual-property rights.
Nothing in these Terms transfers those rights. Any unauthorised reproduction, extraction, adaptation or exploitation is prohibited, subject to exceptions provided by law.
12. Third-party services, equipment and content
BikeAsOne may rely on third-party services or equipment, including mapping, GPS, browsers, operating systems, Bluetooth, sensors, connected accessories, hosting providers or external platforms.
These services are subject to their own terms and may change or become unavailable independently of BikeAsOne. The publisher does not control their availability, accuracy or changes.
13. Liability
BikeAsOne is used under the user’s responsibility. To the extent permitted by law, the publisher shall not be liable for damage resulting exclusively from misuse of the service, failure to comply with these Terms, incorrect information supplied by the user, third-party equipment or services, loss of connection, GPS or Bluetooth failure, or failure to take actual traffic conditions into account.
Users are encouraged to keep their own backups of important data they wish to preserve. BikeAsOne must not be regarded as the sole means of backing up essential information.
The limitations in these Terms do not apply where liability cannot legally be excluded or limited, including under mandatory consumer-protection provisions or where the law provides otherwise.
14. Force majeure and external events
The publisher shall not be liable for delay or non-performance resulting from an event meeting the legal conditions of force majeure. Depending on the circumstances, the service may also be affected by widespread network outages, infrastructure failures, cyberattacks, natural disasters, authority decisions or major failures of external providers.
15. Suspension or deletion of an account
An account may be suspended or deleted in the event of a serious or repeated breach of these Terms, fraud, attempted security compromise, unlawful use, or where necessary to protect BikeAsOne, its users or third parties, subject to rights and procedures required by law.
16. Personal data and privacy
Personal-data processing is governed by the BikeAsOne Privacy Policy and applicable law. Geolocation, activity or sensor data may be particularly sensitive in practice; users should take care when choosing who to share it with.
These Terms do not replace the Privacy Policy, which sets out in particular processing purposes, legal bases, retention periods, recipients and data-subject rights.
17. Changes to these Terms
These Terms may be amended to reflect changes to the service, regulations, security or BikeAsOne practices. The applicable version is identified by its update date. Where required by law or where a change materially affects an ongoing contractual commitment, appropriate information will be provided to affected users.
18. Applicable law, complaints and final provisions
These Terms are governed by French law, without depriving consumers of mandatory protections available under the law applicable to them.
In the event of a difficulty, users are invited to contact BikeAsOne to seek an amicable solution. Available remedies, competent courts and, where legally applicable, consumer mediation arrangements remain those provided by law.
If any provision of these Terms is declared void, unenforceable or unwritten, the remaining provisions continue to apply to the fullest extent permitted by law.
